Why are Mold Lawsuit Cases Rising?

Lawsuits against building owners, contractors, and insurance companies have skyrocketed over the last 10 years. Many people blame the increasing American culture of wanting to sue.

However, many factors play into the overall increase of claims being filed.

Many fears of mold, and the claims that go with them, are without warrant, though there are a number of valid claims that are filed every day.

Judges and juries have already awarded millions in several lawsuits regarding health and home damage that resulted from mold exposure.

Desert State Claims Rise Even Faster

In desert states such as Arizona and New Mexico, the number of mold claims against insurance companies continues to rise faster than in any other part of the nation.

This is due to the increase in new construction, as well as the need of the occupants to use air conditioners, which can trap and redistribute mold spore.

With more homes being built, more water being run into commercial buildings, and more people being aware of the hazards of mold, lawsuits will only continue to rise until legislation or insurance limits are put in place.

i have water damege in my roof the inside came down it was filled with black mold my girl had it all over her but there is more mold growing my girl is allway sick she has bad head pain and if its that bad she has to go to the hospitle to help her get it in control she has a hard time breathing too

I think the number of mold cases rises in direct proportion to the number of homes that are underwater. Mold has always been with us and always will be. When people get sick (or underwater) they try to blame it on something. Since everyone has mold it is a good culprit. CDC in Atlanta has a good link .. ie not much medical problems are caused by mold.

My crawlspace under my first floor apt townhome has a continuis leak, Beleaved to be sewage. It is totaly muddy down there. when this was exposed on sept 18th the land owner told me to move or be evicted. City is comeing out today. I hope for a resolution. Peace

i bought a brand new house in 2009 told them to take there time were in no hurry to move in about a yr ago i pulledarport out of a bed room slab is craced, my ceilings are cracked we have had sinus problems since day one last year we started having black sfuff comimg out vents i looked it up and says its mold . we are giving up house but what can we do about it

There is black mold growing in the bathroom landlords are not taking this seriously have made several complaints but they just keep saying they will call to make an inspection date but never do.
Frustrated in Cali.

I have argued with mylandlord over blackmold for the past two years. We have many health problems and need to get legal representative in southern Cal.

Every spring I ask my landlord to fix roof leaks and mold infested walls. I’m always told that someone will be there to take care of it. When she comes every two weeks it’s only to collect rent. I need help please. I have a one year old grand baby and my own kids.

I have black mold in certain areas of my home. Who is responsible ? Please get back too me my mobile home on own ground. Not sure If previous owner knew about that or not? Thanks

I have recently had to vacate a commercial property because of mold. The property management ignored my requests for remedies. I have been ill and they are asking for money and releasing the suite without fixing the mold issue. We did a 24hr air monitoring and the results confirmed four types present. What can I doto get compensation for my loss?

JUST FOUND OUT WHY MY KIDS ARE SICK. BLACK MOLD. LIVED HERE OVER 5 YEARS. MOLD SMELL KEPT POPPING UP ASK LANDLORDS . EMPLOYER OF LAND LORD TO PLEASE FIX LEAKS. FOR YEARS WE HAVE BEEN PUT OFF . MY MOM CALLED A MOLD INSPECTOR AND GUESS WHAT ALLSTATE LABS WE HAVE MOLD. YOU SAID SO WE NEED HELP .

I been having a big leak in my roof since i moved in my apt in Jan/2014 I been telling my lanlord i need it fix, every time it rains hard it leaks in gets my couch wet now I have to replace my couch an I also called the health department to come out an look an they said they was gone get them to fix stil hasnt been fixed an i think there mold

My house was built in 1971 and now I see mold on the basement walls and corner of walls upstairs.The contractor built these homes where it use to be a swamp and most of the other houses have no basement.But ours have a basement.Can I still sue the contractor and these were fha 235 homes!

My apartment complex said we had a pipe burst behind our washer and it wasn’t safe to live there. They gave us temporary housing. But there is mold in the apartment and would explain why we are always sick.. what can be done about this, they lied to us

I am dealing with mold n mildew in my apartment I brought it to the landlords attention I have also contacted the code enforcement which came out and told them that it was mold than I also have picture videos recordings of them so called fixing it by spraying bleach and water on the mildew also have dr. State Mentt from my kids doctor stating that my son asthma is flaring and wheezing due to mold my son has broke out in rashes due to mold and mildew they’re having fevers their nose bleeding due to mold n mildew only thing I have not gotten is an air test they cost so much this is hindering me from trying to file a lawsuit is there anyway I can get this test done for free or to get it done by someone into my case is resolved I know I have it good case and I know for a fact the mole and the mildew is what is causing my kids to be sick someone please help me I need answers as soon as possible

My home is condemed with black mole. Pets have all died, and I to am dying. I MUST VACSTE MY PREMISSES TODAY. The park has never fixed the run off of access swamp water that floods my yard causing water damage, and now Today I have black mole.I live on SSD of $768.00 a month. I am scarred,sick no place to go I can’t that any of my property with me, even my clothing. Please help?

I owned my home, and now I don’t even own my life. I am alone, scared very sick constantly, and no place to go at 70 years old. I have recently lost 3 dogs do to internal bleeding, and seizers. Now my last dog is suffering the same consequences. I also am either at docters, emergency, or in for tests, breathing, etc cancers or admitted to hospital.Now I found out today that my home is contamined with black mole.

House is 15 years old. Encapsulated with dehumidifier. Mold in ductwork and on wood. No source of water. Current Hvac co found ductwork to return missing and no end cap. Mold inside. Original Hvac company did not put in all ductwork but was paid complete. Heater rusted inside and must replace. Mold illness for 2 years. Who is responsible, can I sue?

I’ve been renting here for approximately a year and a half. I got pansinusitis right after moving in and still have it living on antibiotics. On top of that I have swarms of water bugs which are part of the roach family. The complex owner has done nothing about either. The apartments are subsidized and I can afford to just move out to some place else. I found out the bugs are also causing the sinus problems so I have problems year round.
